As compensation, the jury entered a verdict in excess of $1 billion, inclusive of punitive damages.  However, this was later reduced to approximately $500,000 after being held unconstitutionally excessive.

The primary factory identified by one metallosis attorney on the case was the failure of the manufacturer to undertake any human testing prior to introducing the product to the marketplace.  As such, problems that could easily have been identified and corrected went unnoticed.  This is what left many hip implant recipients feeling like test cases.
