Exactech hip, knee and ankle replacement lawsuits have been reviewed by the U.S. Judicial Panel on Multidistrict Litigation (JPML). Upon due consideration, the JPML selected the Eastern District of New York (EDNY) as the venue in which Exactech implant claims would be heard by the federal court system.
The Eastern District of New York is part of the 2nd circuit of the U.S. court system, and appeals are heard by the Second Circuit Court of Appeals.
Consolidation of a multitude of Exactech lawsuits in New York’s Eastern District was done pursuant to 28 U.S.C. § 1407. Newly filed cases nationwide are expected to likewise be transferred the EDNY.
